Sub: - Procedure for export of goods from Mangalore

Port through Gateway Ports like Mumbai,J.N.Port

Etc, and from Mangalore as Gateway port

It is notified for information of all Steamer Agents, CHAs, Exporters and all other concerned that to facilitate the movement of export cargo emanating from one port to be shipped from another Gateway Port the following procedure is prescribed.

  1. EXPORT OF CONTAINERS FROM MANGALORE PORT FOR SHIPMENT THROUGH OTHER GATE WAY PORTS BY COASTAL FEEDER VESSEL:

    1. Only those Steamer Agents who are registered at Custom House, Mangalore can operate the vessel for export/import of goods from Mangalore Port through other Gateway Ports.

    1. For export goods, the shipping bills may be passed at Mangalore Custom House and export be allowed subject to the condition of execution of bonds as provided under Regulation 4 of Goods Imported (conditions of transhipment) Regulations 1995 and the export goods are manifested for the final destination through the transhipment Port as, "To Amsterdam through JNPT". Bond to be executed by the Shipping Agent shall be as prescribed by Commissioner of Customs, Mangalore (Sample Bond Enclosed), and the validity of the said Bond shall be one year from the date of execution.

    2. The Shipping Bills relating to transhipment cargo will be processed under the EDI systems. The Exporter / CHA will file shipping bill as usual in the EDI system. 2 photocopies of the original will be taken and Rubber Stamp has to be affixed on the photo copies as "transference copies" and attested by the Superintendent (Docks). These copies will be used as transference copies. In addition to the usual information given in the shipping bill, the Exporter will also mention the Gateway Port of Export on the shipping bill. Each copy of the shipping bill will be endorsed that the goods are to be transhipped through Gateway Port other than Mangalore Port along with the name of the Gateway Port manually by the Superintendent (Docks).

    3. Till such time necessary software is developed by the Department of system, the fact that the export goods are transhipped cargo should be entered in the departmental comments and manually on all the copies of the shipping bills by the Superintendent (Docks).

5. The shipping bills will be processed in the usual manner. The cargo will be examined and stuffed and the container will be sealed by the officer of Customs /Central Excise as per the existing procedure.

6. The Appraising Officer /Superintendent (Docks) shall give "Let Export Order" on the duplicate copy of the bill as also on both the transference Copies.

7. The Inspector (Docks) section will examine the ‘Let Export Order’ and allow shipment on the duplicate copy of shipping bill and both the transference copies, after the contents are received on board and endorsed by the Master of the Vessel on duplicate copy of the shipping bill, the Inspector (Docks) will endorse the duplicate and both the transference copies of S/B as supervised the shipment on board the Feeder Vessel MV/S.S……………. , giving the Container Numbers and Seal Numbers. After endorsement, he will hand over transference copies to the Supdt. (Dock) Section and duplicate S/B to the Steamer agent.

8. As per the Drawback Rules, the drawback is to be paid when the shipping bills are passed and goods are loaded in the Port. Similarly in this case also the drawback may be paid to the Exporters as soon as the shipping bills are passed and goods are shipped at the originating Port subject to the condition that the necessary bond has been executed by the Steamer Agent to bring back and submit the proof for export to the Custom House within 90 days. For endorsement and release of AR4s the procedure prescribed by Board’s Circular No.354/70/97-CX-6 dated 13.11.97 will be followed. The submission of proof of export by the Steamer Agent will be strictly monitored by the Superintendent (Docks).

9. Superintendent (Dock) assigned the work of transhipment under this Public Notice, shall maintain a separate register (In Annexure A) for such cargo and noting down the details of the shipping bills vessel-wise. He will ensure that the two transference copies of the Shipping Bill shall be placed in a sealed cover and handed over to the Steamer Agent, who will be responsible for producing it along with the containers to the Customs Docks Officer/Boarding officers at the Gateway Port. The Dock Section will forward the details of such shipping bills vessel-wise to the Asst/Dy Commissioner, Export Section/Drawback Section,Gr. VII, as the case may be, in Form-I.

10. The Shipping Agent will continue to file EGM in respect of containers transhipped to Gateway Port showing the export goods are manifested for the final destination through the transhipment Port (Hub Port) as, "To Amsterdam through Chennai"

11. The Shipping Agent shall deliver the transference copy of shipping bill duly endorsed by customs authority at Gateway Port to Supdt. Docks Section within a period of 90 days as a proof of export.. On receipt of Transference copy of the shipping bill from the Gateway

Port, the Dock Section shall enter the date of receipt of transference copy in the register maintained for this purpose. The Supdt,( Dock) will ensure that the transference copies are delivered to Export Section/Drawback Section/preferable on the same day or on the next working day. The concerned section of the Custom House will thereafter process the documents as per the prescribed procedure for drawback, DEEC, DEPB benefits etc.

    1. The Supdt. Docks will prepare summary of all outstanding entries where transference copy is not received from the Gateway Port on the last working day of every month and submit the same for perusal to Asst.Commissioner/Deputy Commissioner in charge. The register will be put up for perusal of the Commissioner at the end of every quarter.

13. For the amendment of shipping bills from Foreign going vessel to Coastal run in case the shipment is not effected in the original vessel, the Exporters/CHA may apply to the proper officer for amendment of shipping bill after attaching 2 addl. Xerox copies of shipping bills each duly stamped as ‘true copy’ and ‘transference copy’ duly certified by the Dy./Asst.Commissioner (Export)

B)EXPORT FROM MANGALORE AS THE GATEWAY PORT:

 

    1. The containers at Gateway Port i.e. Mangalore Port will be unloaded and kept separately in Port Trust area under supervision of Superintendent (Docks). The Shipping Agent will hand over the sealed cover containing transference copies to Superintendent (Docks) who will enter the details of all such transference copies in a separate register (Annexure ‘B’) maintained for this purpose, the name of the vessel through which the goods are to be exported from Mangalore Port will be endorsed by the Inspector (Docks)

    2. At the time of loading of export containers on mother vessel, the Boarding officer/Customs (Docks) Inspector nominated at Mangalore Port will endorse the 2 transference copies of the shipping bill after examining the container in the following manner.

      1. Inspected and found seal intact on the containers bearing the marks and nos. as per the transference copies of the Shipping Bill.

      2. The Custom seal on the above mentioned containers are found intact.

      3. All the containers mentioned above have been shipped under my supervision on the vessel.

      4. Will endorse the name of the mother vessel on both the transference copies.

    3. If seals of the containers are broken at the Gateway Port or anything is suspected suggesting tampering etc. Superintendent (Docks) at Gateway port may examine the goods and make suitable endorsement on the transference copies of the shipping bills. The arrangements for examination would be made by steamer agents who will also produce necessary documents like copy of shipping bills, invoices etc.

    4. As regards short-shipment/shut out cargo from Gateway Port suitable endorsement in the transference copies will be made by the Inspector concerned. The Exporter has to file a fresh shipping bill at the Gateway Port for the shipment of remainder of the cargo on another vessel.

    5. Immediately after shipment of goods from Mangalore Port, the Customs (Docks) officer shall enter the name of mother vessel and date of shipment against the entry made at the receipt of transference copy of shipping bill and will hand over one transference copy to the shipping agent on the strength of which EGM would be filed in that port. The second transference copy in a sealed cover will be handed over to the Shipping Agent by Supdt. Dock who will submit the same to the Asst. Commissioner at the port of filing of shipping bill/originating port for endorsing EP/AR-4 copies and processing the documents as per the prescribed procedure for drawback, DEEC & DEPB benefits.

Nothing contained in this Public Notice shall adversely affect the right of the proper officer or Customs at the port of export to detain/check and to call for any information that is considered necessary before allowing transhipment or export at the Gateway Ports.
