PUBLIC NOTICE NO. 17/2000 

SUB : BONDING OF GOODS UNDER SECTION 49 OF THE CUSTOMS ACT,1962 

            Attention of importers / CHAs and all other concerned is invited to the provisions contained in  Sec 49 of the Customs Act 1962, wherein imported goods, on an application from the importers can be permitted to be stored in a public bonded warehouse or a private bonded warehouse. 

2.                  As per minutes of the meeting of Customs and Central Excise Advisory Council held at New Delhi on 30th and 31st January 1984, it was decided to permit storage of imported goods only if the importers deposit the duty amount before allowing storage of goods under Sec 49 of the Customs Act, 1962.   All major Custom Houses are also following this practice. 

3.                  Therefore it has been decided by this office also to follow the decision taken in the Customs and Central Excise advisory council meeting.  The Importers and CHAs are therefore advised that henceforth, bonding of imported goods will be permitted under Sec 49 only if the importer deposits the duty payable before permission is granted for depositing the goods in terms of Sec 49 of Customs Act 1962. Consequently, instructions contained in this office Public Notice No. 3/92 dated 24.2.92 for storing timber logs under Sec 49 is cancelled.
