Sub: Customs-Budget 2002-2003-Speical Period - Observance of Formalities in Customs matters - Reg.
The Union Budget for the year 2002-2003 is likely to be presented in the parliament on 28.02.2002 at 11.00 a.m. In this connection, the period from 21.2.2002 to 7.3.2002 (both days inclusive) will be observed as "Special Period" for the purpose of noting Bills of Entry, Shipping Bills, granting of Entry Inward and Entry Outward.
The manual Bills of Entry and Shipping Bills should be presented in complete form for noting to the proper officer of Customs up to 4.00 pm during these days except on 28.2.2002. Incomplete documents will not be accepted and shall not be noted. In respect of EDI Bills of Entry the check list and other related documents will have to be verified and approved by the Superintendent (Apprg) before submission of the same in the system by the Service Centre. As regards Shipping Bills, the same will have to be verified and approved by Superintendent (Docks) before submission. In the EDI system also, the Bills of Entry and Shipping Bills will not be admitted after 4 p.m. during the special period. Advance noting of Bills of Entry is not permissible during the said period.
All Bills of Entry received prior to Entry Inwards will be deemed to have been presented for the purpose of Section 15(1) of the Customs Act, 1962 on the date on which entry inwards is granted in respect of imported goods. The rate of duty applicable to any export goods shall be the rate in force on the date of granting the ‘Let Export’ order. The ‘Let Export’ order for manual Shipping Bills will be granted by the Deputy / Assistant Commissioners concerned as the case may be during the Special Period. In respect of Shipping Bill presented under the EDI system, the Superintendent (Docks) will give ‘Let Export’ in the system after getting approval from Dy Commissioner (EDI)
In terms of Sec.4 of the Provisional Collection of Taxes Act, 1931, the provisions of the Finance Bill will take effect from the midnight of 28.2.2002/1.3.2002. The rate of duty and the tariff valuation are governed by Sec.15 of the Customs Act, which stipulates that the same shall be those in force on the date on which the Bill of Entry is presented or the date of entry inwards whichever is later. For the sake of uniformity and as per the directions of Ministry of Finance, Department of Revenue, no noting of the Bill of Entry shall be made on 28.02.2002 at Custom Houses or Air Cargo Complexes/ICD/CFS/ minor ports. Similarly no clearances will be allowed from any Bonded Warehouse under Section 68 of the Customs Act for ex-bonding the warehoused goods. In respect of EDI system at New Custom House, Mangalore, no Bill of Entry and Shipping Bills will be accepted and assigned with a number at the Service Centre on 28th February 2002.

Customs-Restriction on clearances on the Budget day–Union Budget 2002-2003 Instructions - Reg.----------------
The Finance Bill for the year 2002-2003 is likely to be presented before the Parliament on 28th February 2002 at 11 A.M.
In terms of Section 4 of the Provisional Collections of Taxes Act, 1931, the provisions of the Finance Bill will take effect from the midnight of 28th February 2002/1st March 2002. The rate of duty and tariff valuation of imported goods is governed by Section 15 of the Customs Act, which stipulates that the same shall be as in force on the date on which the Bill of Entry is presented or the date of Entry Inwards whichever is later. For the sake of uniformity, no noting of the Bill of Entry shall be made on 28th February 2002 at Custom House. Similarly, no clearances should be allowed from any bonded warehouse under Section 68 of the Customs Act, for Ex-bonding the warehoused goods. In respect of EDI system at New Custom House, Mangalore also, no Bills of Entry and Shipping Bills will be accepted and submitted in the system at the Service Centre on 28th February 2002. The Dy Commissioner (Appraising) Mangalore shall, on 28th February 2002, freeze the last number of the Bill of Entry and Shipping Bill at the Service Centre and Import/ Export Section. Only on his specific instructions on 1st March 2002 the process of submission to Customs and assignment of Bill of Entry and Shipping Bill numbers shall resume.
As regards warehouses, the Dy/Asst Commissioners should ensure that the Superintendents in charge of warehouses check the stock of the warehoused goods at the end of the previous day i.e. on 27th February 2002 and take possession of the keys of the warehouse.
The Dy /Asst Commissioners should keep in their custody the registers for noting and also the stamps during the Special Period i.e. from 21st February 2002 to 7th March 2002 (both days inclusive). They should also initial in the register at the beginning and at the end of each day during the said period. The Bills of Entry and Shipping Bills will not be accepted after 4 p.m. during the special period. No Advance noting of Bills of Entry is permissible during the said period. Herein also the Dy / Asst Commissioners in charge shall ensure that no admission is done on 28th February 2002 and the instructions are strictly followed. The above instructions may be brought to the notice of all the concerned.
